On 6 June 2026, the Ho Chi Minh City Department of Home Affairs (“HCMC DOHA”) issued Official Letter No. 10165/SNV-VLATLĐ (“OL No. 10165”), providing guidance on the submission of the occupational accident report for the first half of 2026. OL No. 10165 reiterates the reporting obligations applicable to employers headquartered in Ho Chi Minh City and specifies the reporting period, submission methods, and implementation requirements.
This reporting obligation forms part of employers’ compliance responsibilities under the Law on Occupational Safety and Hygiene 2015, Decree No. 39/2016/ND-CP, and relevant implementing regulations governing occupational accident statistics and occupational safety and hygiene (“OSH“) activities.

1. Reporting obligation
Enterprises, organizations, institutions, and individuals employing workers (collectively referred to as employers) with their head office located in Ho Chi Minh City are required to submit:
- the Consolidated Occupational Accident Report at Enterprise Level; and
- the report on OSH activities,
using the reporting form prescribed in Appendix XII of Decree No. 39/2016/ND-CP.
The report must cover occupational accident data arising during the period from 1 January 2026 to 30 June 2026.
2. Information to be included
In addition to the prescribed reporting contents, employers should ensure that the report accurately states:
- the employer’s head office address in accordance with the new two-tier administrative structure applicable in Ho Chi Minh City;
- the name of the person preparing the report;
- contact telephone number; and
- email address.
Employers are encouraged to carefully review these administrative details before submission to avoid unnecessary requests for amendment or supplementation.
3. Submission methods
Employers may choose either of the following submission methods:
Method 1 – Online submission
Submit electronically through the Occupational Accident Information Management System at:
atld-sldtbxh.tphcm.gov.vn
(The HCMC DOHA has also issued detailed user instructions for online submission.)
Method 2 – Hard-copy submission
Where online submission is not feasible, employers may submit the report directly or by post to the HCMC DOHA. According to OL No. 10165, reports may be submitted to one of the HCMC DOHA’s designated offices.
4. Reporting period
The HCMC DOHA will receive reports from 22 June 2026 before 5 July 2026.
Employers are therefore advised to prepare the required information in advance to ensure timely submission within the prescribed reporting window.
Compliance reminder
Failure to comply with the statutory reporting obligation may expose employers to administrative sanctions.
Pursuant to Decree No. 12/2022/ND-CP, organizations that fail to submit periodic reports on OSH in accordance with applicable regulations may be subject to administrative fines of up to VND 20,000,000, depending on the nature and severity of the violation.
Our observations
The issuance of OL No. 10165 reflects the authorities’ continued emphasis on strengthening OSH compliance and improving the collection of occupational accident statistics across Ho Chi Minh City.
Employers should verify that their reporting data is complete and accurate, ensure that the prescribed reporting template is used, and submit the report before 5 July 2026 to avoid potential administrative penalties.
