Kazakhstan’s Golden Visa: What Foreign Investors Should Know Before Applying

Kazakhstan has recently introduced a new investor visa framework, commonly referred to as the “Golden Visa”, as part of its broader effort to attract foreign capital and long-term business residents. Under the new rules, foreign nationals who invest at least USD 300,000 in the charter capital of Kazakh companies or in local publicly traded securities may apply for an investor visa. The mechanism may also provide an opportunity to obtain a residence permit in Kazakhstan for up to 10 years.

For international investors, the new regime should not be viewed only as an immigration tool. It is also a legal and strategic instrument that may support business ownership, asset management and long-term commercial presence in Kazakhstan.

1. Understand the Purpose of the Golden Visa

The Golden Visa is designed for foreign investors who need a more stable legal basis for staying in Kazakhstan while developing local business interests or managing investments.

Unlike ordinary business visas, which are usually connected to short-term travel or specific commercial visits, the investor visa may be relevant for individuals who require repeated or long-term access to Kazakhstan for corporate, investment or private wealth purposes.

This makes the program particularly relevant for entrepreneurs, high-net-worth individuals, shareholders of Kazakh companies, and investors seeking exposure to Kazakhstan’s capital market.

2. Choose the Right Investment Route

The new framework provides two main investment routes: investment into the charter capital of a Kazakh company, or investment into local publicly traded securities.

Each route has different legal and practical consequences. Investing into a company may be more suitable for entrepreneurs planning to establish or acquire an operating business. Investment into securities, by contrast, may be more relevant for investors seeking financial exposure to Kazakhstan without direct operational management.

Before choosing the route, investors should assess whether the investment structure is compatible with their business plan, risk appetite, tax position and exit strategy.

3. Prepare the Legal and Compliance Documentation

A successful Golden Visa application will likely depend not only on meeting the investment threshold, but also on proper documentation.

Investors should be prepared to provide clear evidence of the investment, source of funds, beneficial ownership, corporate documents, banking records and any other materials required by the competent authorities or financial institutions.

In practice, compliance checks may become one of the most important stages of the process, especially where the applicant uses a multi-jurisdictional corporate structure, holds assets through investment vehicles, or transfers funds from abroad.

4. Consider Tax and Residence Implications

Obtaining an investor visa or residence permit does not automatically solve all tax questions. Investors should separately analyze whether their physical presence, business activities or asset ownership may create tax residence, reporting obligations or taxable income in Kazakhstan.

Key issues may include taxation of dividends, capital gains, investment income, controlled company structures, cross-border payments and interaction with the investor’s existing tax residence jurisdiction.

For this reason, the Golden Visa should be planned together with tax advice, rather than treated as a standalone migration procedure.

5. Work with Local Legal and Tax Advisors

The Golden Visa may create a valuable opportunity for foreign investors, but its practical success will depend on how the investment is structured, documented and implemented.

Legal and tax advisors can assist with selecting the appropriate investment route, preparing corporate and compliance documentation, reviewing tax implications, coordinating with banks and authorities, and ensuring that the investor’s residence strategy is aligned with the broader business plan.

Kazakhstan’s Golden Visa therefore represents more than a new residence option. Properly structured, it may become a useful gateway for foreign investors seeking a long-term and legally secure presence in Kazakhstan.
